TERMS AND CONDITIONS OF USE

Cincinnati Children’s Hospital Medical Center (CHMC) is pleased to offer you access to some of your or your child’s/guardian’s medical information via a Web-based version of our computer charting system called MyChart. If you have any questions about the content contained in the MyChart account, please contact your physician.

We think it is important for you to know how we handle your or your child’s/guardian’s information communicated via the Internet. This Terms & Conditions of Use outlines CHMC’s practices regarding MyChart information access and our sensitivity to the right to privacy. By accessing a MyCharts account, you confirm that you have read this document and agree to be bound by the terms, conditions and statements contained in this document. CHMC may revoke access to MyChart at any time for any reason.

Urgent matters – You should never use MyChart for urgent matters. For all urgent matters, please contact a physician’s office by telephone, go to an emergency room or dial 9-1-1.

Access – Parent(s)/Legal Guardian(s) of a CHMC patient may request access to a minor patient’s MyChart account by completing and signing the MyChart Agreement and submitting it in person to CHMC. CHMC will grant access to individuals with parental rights or legal guardianship with respect to the patient. If CHMC grants a parent/legal guardian access to a patient’s MyChart account, such parent/legal guardian is considered a “proxy” and a MyChart account will be activated for both the proxy and the patient. If the proxy’s legal relationship with the patient changes, the proxy must (and the patient may) inform CHMC immediately by calling CHMC at 877-508-7607 or 513-636-5019 or sending written notice to CHMC at CHMC-MyChart, MLC 9004, 3333 Burnet Ave Cincinnati, OH 45229-3039.

For patients age 13-17, CHMC requires that the patient sign an assent form before it creates the proxy access. If the patient revokes his/her assent, CHMC will terminate access for the patient as well as the proxy(ies).

In addition to Parent(s)/Legal Guardian(s) access to a patient’s MyChart account, CHMC allows patients age 13 and older to access his/her own medical information following signature on the MyChart Agreement. We do this to encourage mature teenagers to take control of their medical care.

Except under special circumstances, CHMC will automatically terminate access to MyCharts by Parent(s)/Legal Guardian(s) when the patient turns 13 years old so that s/he has the opportunity to assent to access by Parent(s)/Legal Guardians. CHMC will automatically terminate proxy rights when the patient turns 18 years old, except under special circumstances.

Security and Confidentiality – CHMC is committed to protect the confidentiality of medical information. We afford the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored in medical charts at CHMC and other medium. We limit CHMC employees’ access and ability to enter or view information based on their role in a patient’s care. Firewalls, passwords, encryption and audit trails are further used to safeguard medical information. We identify the records released to note the time and date of access each time the MyChart account is accessed. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. You agree that if you accidentally gain access to another patient’s information, you will stop viewing it and will notify CHMC by calling CHMC at 877-508-7607 or 513-636-5019. In no event will you deliberately attempt to access information for any person other than your or your child’s/guardian’s information. If this occurs, CHMC will terminate your access.

Your role in maintaining the security of the MyChart account to which you have access is: 1) Changing your password on a regular basis, and 2) Keeping your login ID and password confidential.

You understand that no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. When you access a MyChart account, information will be transmitted over a medium that is beyond CHMC’s control. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by us, medical information will be treated as confidential and given the same protection that all other CHMC medical records are given.

For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 3.0 or greater). Our SSL Web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to CHMC by viewing the digital certificate. This certificate verifies the connection between the CHMC server's public key and the server's identification.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet.

MyChart I.D. and Password – When you initially enroll in MyChart, CHMC provides you with an access code which you use to create a personal login name (“MyChart I.D.”) and a password. Once this access code has been used, it is no longer valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access the same confidential medical information you can. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password and to change your password if you feel that your security has been compromised. You may change your password at any time.

You understand and agree that CHMC takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record confidentiality resulting from your sharing or losing your password. If CHMC discovers that you have inappropriately shared your password or that you may have misused or abused your access privileges in any way, access to MyChart may be terminated immediately.

Response to Electronic Communication – CHMC will use reasonable effort to provide a timely response to electronic inquiries. You should allow at least at least two (2) business days for a response. If the CHMC provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within CHMC for a timely response to your request. With respect to any electronic communication, CHMC is only able to respond to such communications based on the information you provide. If the information is insufficient, CHMC will be unable to provide accurate and reliable services.

Email Privacy – All communications between you and health care providers using MyChart occur over a secure connection. You will, however, receive internet email messages notifying you that new information is available in your MyChart account. These email messages will not contain any confidential medical information. However, any person with access to your email account will be able to see this notification. This can include you, your spouse, employer or anyone else that can access a your email account. You should take this into account when providing an email address.

Your Responsibilities - You agree that MyChart is a communication service offered as a convenience to you. You understand that it provides you with online access to portions of your or your child’s/guardian’s CHMC electronic medical record and that you are solely responsible for any sharing of such content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate CHMC department as necessary for handling, and therefore CHMC employees, other than your or your child’s/guardian’s healthcare provider may be involved in addressing your request. Therefore use of the MyChart account may not be appropriate if there is sensitive information that you would only wish to discuss directly with a particular medical provider. You understand that entries you make using MyChart may become part of the medical record.

You understand that you may not transmit any information or message that contains unlawful, threatening, fraudulent, libelous, defamatory, obscene or abusive information or language. MyChart may not be used for any illegal or unethical activities. Hacking, attempted access or other forms of inappropriate access or attempted access to unauthorized areas or information on this site will lead to termination of use and potential legal prosecution.

web site Links – CHMC may offer links to related medical websites not managed by CHMC. These website links are for informational purposes only. CHMC does not endorse and has not verified the accuracy of the information in/on these websites, and you should not rely on any of the information found on the websites for purposes of treatment or diagnosis.

Scope of Access – The MyChart account to which you have access may not contain all of a patient’s medical information and you agree to access such account knowing that it may be incomplete.

No Warranties - This site and the content contained herein are provided by CHMC on an "As Is" basis. CHMC makes no representations or warranties of any kind express or implied as to the operation of its sites, or the content, products and/or services included therein. To the fullest extent permissible by applicable law, CHMC disclaims all warranties, express, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and/or infringement.

Limitation of Liability - Some of the material on the CHMC site is provided by third parties and CHMC shall not be held responsible for any such third-party material. CHMC disclaims any responsibility for, or liability related to, such third-party material. Any questions complaints or claims related to any product should be directed to the appropriate third party.

General - By using CHMC's Web site, you agree that the laws of the state of Ohio, without regard to principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute that might arise between you and CHMC, its doctors, nurses, staff or other affiliates. You expressly agree that exclusive jurisdiction for any dispute with CHMC, its affiliates, employees, subsidiaries, contractors, officers and directors, resides in the courts of Hamilton County, Ohio and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Hamilton County, Ohio in connection with any claim involving CHMC, its affiliates, employees, subsidiaries, contractors, officers and directors. Use of CHMCs Web site is unauthorized in any jurisdiction that does not give effect to the terms and conditions set forth herein.
